Effective Date: January 1, 2026
Welcome to FamilyKinky.com (the “Site”), operated by FamilyKinky Home Improvements (“FamilyKinky,” “we,” “us,” or “our”). These Terms and Services (“Terms”) govern your access to the Site and your use of any information, tools, forms, or content we provide online in connection with residential home improvement, remodeling, renovation, repair, and related services (collectively, the “Services”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
You must be at least eighteen (18) years old and able to form a binding contract to use the Site or submit inquiries. When you provide information through contact forms, subscription forms, or other interactive features, you represent that the information is accurate, current, and complete. You are responsible for maintaining the confidentiality of any credentials associated with future account features and for all activities that occur under your account.
Information on the Site—including project photos, pricing ranges, service descriptions, blog articles, and downloadable materials—is provided for general informational purposes only. It does not constitute professional engineering, architectural, legal, or financial advice. Project outcomes depend on site conditions, material availability, code requirements in your locality, and scope decisions made during consultation. Always obtain a written proposal before authorizing work.
Online pricing pages display illustrative starting points, not binding quotes. A renovation contract is formed only when both parties execute a written agreement that defines scope, schedule, payment terms, warranties, and change-order procedures. Verbal statements, email summaries, and website content do not replace signed contracts. We reserve the right to decline projects that present safety risks, code conflicts, or scheduling constraints we cannot reasonably meet.
Home improvement projects frequently evolve as hidden conditions are discovered or as you select upgraded finishes. Any modification to agreed scope, materials, or timeline will be documented in a change order describing cost and schedule impacts. Work associated with a change order will not begin until you approve the change order in writing unless emergency conditions require immediate action to prevent property damage.
Proposals may include allowance lines for fixtures, tile, appliances, or other selections not finalized at signing. If your final selections exceed the allowance, you agree to pay the difference. If selections cost less than the allowance, contract terms will specify whether unused allowance is credited or reallocated.
You agree to provide safe access to work areas, utilities as needed, and reasonable storage for materials and tools. You are responsible for securing pets and notifying us of alarm systems, sprinklers, or fragile landscaping near work zones. Delays caused by weather, material lead times, inspection availability, or events outside our reasonable control may extend completion dates without constituting a breach of contract, provided we use commercially reasonable efforts to resume work promptly.
Payment schedules will be stated in your project agreement. Unless otherwise specified, deposits are non-refundable once materials are ordered or scheduling resources are committed. Late payments may pause work and incur fees as permitted by law. Third-party financing offers displayed on the Site or discussed during consultation are subject to lender approval and separate lender terms. We are not responsible for lending decisions or interest terms imposed by financing partners.
Workmanship warranties, if offered, are limited to the duration and remedies stated in your signed contract. Manufacturer warranties apply to products and must be registered according to manufacturer instructions. Except as expressly stated in a written contract, the Site and any preliminary communications are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
All Site content—including text, graphics, logos, icons, photographs, layouts, and software—is owned by FamilyKinky or its licensors and protected by copyright, trademark, and other intellectual property laws. You may view and print pages for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site content without our prior written consent.
When you submit photos, testimonials, reviews, or project feedback, you grant FamilyKinky a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and portfolio purposes unless you notify us in writing that you revoke permission for future use. You represent that you own or control rights to any content you submit and that it does not violate privacy rights of third parties.
You agree not to:
The Site may reference third-party websites, social platforms, or supplier catalogs. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party resources is at your own risk and subject to their terms.
To the fullest extent permitted by applicable law, FamilyKinky and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or reliance on online content. Our aggregate liability for claims related to the Site shall not exceed one hundred dollars (USD $100) or the amount you paid us for online-related services in the twelve months preceding the claim, whichever is greater. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless FamilyKinky from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of third-party rights resulting from content you provide.
Our collection and use of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to those practices.
By submitting forms on the Site, you consent to receive responses by email regarding your inquiry. Marketing messages are sent only in accordance with your subscription preferences and applicable law. You may unsubscribe using the link in promotional emails or via our unsubscribe page.
These Terms are governed by the laws of the jurisdiction specified in your signed project contract for construction services, or otherwise by the laws applicable to FamilyKinky’s principal place of business, without regard to conflict-of-law principles. Parties agree to attempt good-faith negotiation before pursuing formal dispute resolution. Where permitted, you and FamilyKinky may agree to binding arbitration in a signed project contract.
We may update these Terms periodically. The “Effective Date” at the top will reflect the latest revision. Material changes will be posted on this page. Continued use of the Site after changes constitutes acceptance of the updated Terms.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Failure to enforce a provision is not a waiver of our right to enforce it later.
